Terms of Service
These Terms of Service set out the rules for the use of the Cogito Realizacje website and the rules for the provision of electronically supplied services in accordance with the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means (Electronic Services Act).
§ 1. General provisions
- The Operator of the Website and the Service Provider is Cogito Realizacje Sp. z o.o., with its registered office in Żelazków (Witoldów 3, 62-817 Żelazków), entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0001089357, NIP 9681011126, REGON 527845502 (hereinafter: the Service Provider).
- The Website is available at the internet address indicated by the Service Provider. Use of the Website is free of charge.
- A User is any person using the Website (hereinafter: the User).
- These Terms of Service are made available free of charge in a manner that enables them to be obtained, reproduced and recorded by means of an ICT system.
§ 2. Type and scope of services
- Within the Website, the Service Provider supplies the following services by electronic means:
- making available information regarding the Service Provider's activities and the scope of its services, in particular support for foreign physicians in commencing professional practice in Poland;
- making available the contact details of the recruitment team enabling contact by telephone or e-mail;
- handling electronic correspondence initiated by the User.
- The Website is informational in nature. No contracts are concluded through the Website, no paid transactions are carried out, and no binding commercial offers within the meaning of the Civil Code are made. All arrangements regarding cooperation take place outside the Website (telephone, e-mail correspondence, meetings, the signing of a separate contract).
§ 3. Technical requirements
- The use of the Website requires:
- a device with access to the internet;
- a web browser in an up-to-date version (Chrome, Firefox, Safari, Edge or Opera) with JavaScript and cookies enabled;
- a screen of at least 360 pixels in width.
- The Service Provider makes every effort to ensure that the Website is continuously available. The Service Provider reserves the right to temporary interruptions in the operation of the Website for technical or maintenance reasons or due to reasons beyond the Service Provider's control.
§ 4. Terms of use of the Website
- The use of the Website is voluntary and free of charge.
- The User undertakes to use the Website in a manner compliant with the law, good practice and the provisions of these Terms of Service, with respect for the rights of third parties and of the Service Provider.
- It is prohibited to supply to the Website any content of an unlawful nature, in particular content infringing the rights of third parties, misleading content, content that is offensive, or that promotes violence or discrimination.
- It is prohibited to undertake any actions that may disrupt the proper functioning of the Website, in particular attempts to obtain unauthorised access to the system, the installation of malware and the conducting of DDoS attacks.
§ 5. Copyright
- All content available on the Website, including texts, graphics, photographs, logos and the Website's layout, are the subject of the copyright of the Service Provider or of persons who have granted the Service Provider an appropriate licence, and are subject to legal protection.
- Copying, reproducing, modifying and publishing the content of the Website in any manner, in whole or in part, without the prior written consent of the Service Provider is prohibited, with the exception of permitted personal use within the meaning of the Act on Copyright and Related Rights.
§ 6. Protection of personal data
- The controller of personal data processed in connection with the operation of the Website is the Service Provider.
- Detailed rules for the processing of personal data and the information required by Art. 13 GDPR are set out in the Privacy Policy.
- The rules for the use of cookies are set out in the Cookies Policy.
- A User (physician) who provides the Service Provider with the personal data of his or her family members or other third parties declares that he or she has previously obtained their consent for such transfer and has informed those persons of the identity of the data Controller and the means of contacting the Controller.
§ 7. Complaints
- The User may submit complaints regarding the operation of the Website:
- to the following e-mail address: info@cogitozdrowie.pl;
- in writing to the registered address of the Service Provider: Witoldów 3, 62-817 Żelazków.
- A complaint should contain the contact details of the person submitting it, a description of the circumstances and the request being made.
- The Service Provider shall consider the complaint within 14 days of its receipt and shall provide a response to the address indicated by the User.
§ 8. Out-of-court dispute resolution
- The consumer has the option of using out-of-court methods of handling complaints and pursuing claims, including in particular:
- referring the matter to an out-of-court dispute resolution entity registered with the Office of Competition and Consumer Protection (UOKiK), the list of which is maintained by the President of UOKiK at polubowne.uokik.gov.pl;
- applying to a regional inspector of the Trade Inspection Authority with a request to initiate mediation proceedings;
- obtaining free assistance in resolving the dispute through the help of a district (municipal) consumer ombudsman.
- The consumer may also use the European Commission's ODR platform available at ec.europa.eu/consumers/odr.
§ 9. Final provisions
- In matters not regulated by these Terms of Service, Polish law shall apply, in particular the Civil Code, the Electronic Services Act and the GDPR.
- The Service Provider reserves the right to amend these Terms of Service for important reasons (changes in applicable law, changes in the scope or manner of providing services). Users will be informed of any amendments to these Terms of Service at least 14 days in advance through the publication of the new version on the Website.
- The court competent to settle disputes arising from these Terms of Service shall be the court competent for the registered office of the Service Provider. This provision does not affect the rights of consumers arising from mandatorily applicable provisions of law.
- If there is any inconsistency between the Polish version of this document and its translation into another language, the Polish version shall prevail. Translations are provided for informational purposes only.
- These Terms of Service enter into force on 4 May 2026.
